Terms And Conditions

Please review the terms and conditions thoroughly. Your use of this Site or our services requires your acceptance of these terms. If you do not agree, please refrain from using this Site or any of the services offered. This Terms of Use Agreement (“CONTRACT”) from Education Online USA, LLC establishes a legal agreement between you, the (“Customer”), and Education Online USA, LLC (“EO USA, LLC”). By clicking the Purchase Course button (or similar), accessing this Site, or using the EO USA, LLC boater education course service (“Online course”), the Customer agrees to comply with the terms outlined in this CONTRACT. California Notice: Customer agrees that they will obtain an Application ID number from the State of California Boater Waterways before being able to take the boater course final exam. This application ID will be validated electronically and the same Application ID will be used to electronically send the State the valid course completion data. The State of California is responsible to issue a temporary Boater Education Certificate and will later send a permanent Boater Education Certificate via US Mail. All questions regarding the temporary and permanent certificates should be directed to the state agency. New York Notice: Customer agrees that they will receive a 90 temporary certificate issued by EO USA, LLC dba A Quick Boater Course, New York Quick Boater Course. The Customer will have the choice to follow the link provided to obtain an Adventure License issued by the State of New York. In addition, the Customer will have the opportunity to purchase a permanent boater education certificate from A Quick Boater Course, New York Quick Boater Course for an additional fee following the link provided on the completion page. Our terms contain a waiver of the right to engage in a class action or jury trial, as well as a mandatory arbitration clause. The Customer acknowledges that: (i) attempting to bypass the Online course is unlawful; (ii) any attempt to circumvent the course may result in the revocation of the Certificate of Course Completion, court-imposed fines, and/or forfeiture of course fees; and (iii) circumvention includes, but is not limited to, allowing someone other than the registered Customer to take or participate in the Online course. The Customer confirms that all information provided to EO USA, LLC is accurate and truthful. If EO USA, LLC finds that the Customer has misrepresented their identity, they will be removed from the course, and any fees paid will be forfeited. The Customer acknowledges that providing false identity information to complete this state-approved course may lead to charges of perjury or other criminal offenses, as well as potential civil penalties. The Customer understands and consents to EO USA, LLC accessing and using third-party databases (such as driver’s license records, DMV records, credit reports, housing history, and other personal data) to verify the accuracy of submitted information, prevent fraud, or for other permissible purposes. EO USA, LLC may request a notarized Statement of Assurance from the Customer to verify their identity and compliance with the Security and Validation Policy, and the Customer agrees to provide this Statement if requested. The Customer will be assigned an automatically generated username during registration and select a personal password. The Customer acknowledges that they are responsible for maintaining the confidentiality of their password, username, and account, and accepts full responsibility for all activities under their login credentials. The Customer agrees to (a) immediately notify EO USA, LLC of any unauthorized use of their password or account, or any security breach, and (b) ensure they log out from their account at the end of each session. EO USA, LLC is not liable for any loss or damage resulting from the Customer’s failure to comply with these obligations. If EO USA, LLC determines that the Customer has violated or acted inconsistently with the terms or intent of this CONTRACT, the Customer agrees that EO USA, LLC may, at its sole discretion and without prior notice, terminate their access to their username, password, account (or any part thereof), or the Online course. The Customer acknowledges and agrees that this termination may occur without notification, and EO USA, LLC may immediately deactivate or delete the account, along with all related information and files, and prevent further access to these files or the course. Additionally, the Customer agrees that EO USA, LLC will not be liable to them or any third party for terminating access to their username, password, account, or the course. Termination or cancellation of this CONTRACT does not impact any other rights or remedies available to EO USA, LLC, whether by law or equity. Upon termination, all rights granted to the Customer will revert to EO USA, LLC, regardless of the termination reason. All provisions regarding proprietary rights, indemnification, and limitation of liability will continue to remain in effect after termination of this CONTRACT. The EO USA, LLC Privacy Policy is available via a link at the bottom of the EO USA, LLC homepage. By accepting this CONTRACT, the Customer acknowledges that they have read, understood, and agree to the PRIVACY POLICY. This CONTRACT is governed by the laws of the State of California, without reference to its conflict of laws provisions. The Customer agrees that any legal action, whether in law or equity, arising out of or related to the Online course must be filed exclusively in a state or federal court located in Kern County, Bakersfield, California. The Customer irrevocably consents to the exclusive jurisdiction and venue of these courts for any lawsuit, action, or proceeding connected to the Online course. The Customer knowingly, voluntarily, and irrevocably waives any available defenses under federal or state law regarding venue and jurisdiction in Kern County, Bakersfield, California. This forum-selection clause applies to all claims under federal or state law associated with the Online course, including but not limited to contract, tort, and any other statutory or common law claims seeking equitable or legal relief. This clause applies to claims brought individually or as part of a class, whether as a cause of action, counterclaim, cross-claim, affirmative defense, or otherwise. The Customer agrees to indemnify, defend, and hold harmless EO USA, LLC, along with its subsidiaries, licensors, affiliates, and their respective officers, directors, employees, agents, representatives, or subcontractors, from any and all claims or demands, including reasonable attorney’s fees, arising from or related to the Customer’s access, connection to, or use of (or inability to use or access) the Online course (including any information obtained through it), the Customer’s violation of this CONTRACT, or any infringement by the Customer of another party’s rights. In addition to the Governing Law and Forum Selection section, the Customer agrees that any claim or cause of action arising from, related to, or connected with the Online course will be resolved exclusively and conclusively through arbitration in Kern County, Bakersfield, California, as administered by the American Arbitration Association. The arbitration decision shall be final and binding, and judgment on the arbitrator(s)’ award may be entered in any court with jurisdiction. Except where required by law, the Customer knowingly, voluntarily, intelligently, and irrevocably waives any right to appeal the arbitration award, including any appeal of a judgment entered on the award or any related order. The Customer agrees that any claim or cause of action subject to arbitration under this CONTRACT must be brought in an individual capacity, not as a plaintiff or class member in any class or representative action. Additionally, the Customer agrees that the arbitrator shall not consolidate multiple individuals’ claims or preside over any representative or class proceeding. If a court determines that this "Mandatory and Binding Arbitration" section is unenforceable or invalid, this section will no longer apply, but the remaining CONTRACT provisions will continue in full force and effect. If EO USA, LLC undertakes action (either directly or through its representatives) to enforce any provision of this CONTRACT, including the collection of amounts due, EO USA, LLC is entitled to recover reasonable attorney’s fees and all costs associated with any litigation or dispute resolution process. This is in addition to any other relief it may be entitled to, whether by law or in equity. In the event of a conflict between this CONTRACT and any other documents related to the Online course, the terms of this CONTRACT shall take precedence, regardless of whether the other agreement or document was created before or after this CONTRACT, or whether it is signed or acknowledged by any director, officer, employee, representative, or agent of EO USA, LLC.
